Peking, May 19, 1903. WITH reference to my despatch No. 180 of the 6th instant on the subject of the Commercial Treaty, I have the honour to inclose translation of the note from the Board of Foreign Affairs, on which my telegram No. 129 of the 17th instant was based.

Board of Foreign Affairs to Mr. Townley.

THE Board have to acknowledge the receipt on the 7th May of Mr. Townley's note, repeating his inquiries with regard to three points in connection with the Commercial Treaty, the Consumption Tax, the excise, and the provincial remittances to the Board of Revenue; and also inquiring whether lists could be supplied of the native custom-houses and the native opium tax offices.
The subjects on which information is asked all belong to the VIIIth Article of the Treaty. Now it is stipulated that the provisions of this Article shall not come into force until they have received the assent of the different Powers, but up to the present no agreement for the increase of duties to 12 per cent. has been come to with the Powers with whom Treaties have to be negotiated, and therefore the Board suggest that the discussion of the various arrangements should be for the present postponed. As soon as regulations are settled they will send a Note in reply (to the inquiries addressed to them), but at present there is nothing on which action could be based. They are far from having anything to conceal, or from being reluctant to dispel the misgivings of British merchants.
